Title 63, Section 2-402 of the Oklahoma statutes makes the first-time unlawful possession of a controlled dangerous substance a misdemeanor offense punishable by up to one (1) year in county jail and a fine of up to $1,000.00. Second and third possession charges within ten (10) years remain misdemeanor offenses, but with more harsh consequences. If an individual is charged with a fourth violation of the statute within a ten (10) year period, then that charge is a felony punishable by one (1) to five (5) years in the Oklahoma Department of Corrections and/or a fine of up to $5,000.00.

Persons convicted of Trafficking in Illegal Drugs are required to serve fifty percent (50.00%) of their imposed prison sentence before receiving earned credits or becoming eligible for parole consideration. Those convicted of Aggravated Trafficking in Illegal Drugs are required to serve eighty-five percent (85.00%) of their sentence before receiving earned credits or parole consideration.
